Is it a fraud ?

Hello everyone,
Due to the continued lack of response from the responsible party and the absence of a refund, I have initiated legal proceedings. If you reside within the European Union and made your purchase from an EU member state, this situation may be classified under online fraud pursuant to applicable EU consumer protection and criminal law. Legal counsel is currently reviewing the case.

I really don't think it's fair to suggest this is 'fraud'...
There have been several updates about what is going on - both personally for Justine and also with production. Most recent update from March can be found on the Sky's Edge blog, which confirms production is still ongoing and is being outsourced for improved QC pass rates and speed of manufacture. I think this is a case of a tiny start up led by one person getting caught way over the heads by unexpected issues and simultaneously swamped in a massive personal tragedy in the middle of everything else. It's obvious that the situation right now isn't ideal, but I think a lot of people are forgetting that at the bottom of this is one recently bereaved person who started this project as a first-time business venture, just before a disastrous global pandemic that has destroyed and transformed global chip/component supply chains and now a new wave of American tarrifs that have further spiked prices, increased uncertainty and added delays and huge extra overhead costs, which hits small businesses and start-ups the hardest.
The support email address isn't reliably manned at the minute (which obviously isn't great) but even then it's been explained that it was previously being checked on by a family member who has had to take on other work, and that Sky's Edge is looking to hire someone else.
Each to their own of course, but I still have faith in Sky's Edge and in the RUSP project, and I'm not only happy to keep waiting but I think we should all remember the reality of this small company and not get lost imagining this is fraud. In reality this is a tiny, unusual company with a niche, interesting product that only a small group of like-minded people would be interested in, and I think we should maintain patience, especially when we have been given information along the way that makes sense of the delays and gives us insight into what sounds like an awful year.

I think bog-bean has the right of it. Not to mention, your legal proceedings might not get very far; it's hard to squeeze blood from a stone, after all, and given that Justine has been running this on a shoestring, there might not be a lot of "there" there to recover. Go your own way as you will, but I for one am willing to be understanding that I took a risk on a product, knowing it was from a small maker who might have difficulty fulfilling it. I respect her willingness to step into a difficult marketplace and try something new, and I don't consider that fraud.

If our intentions were fraudulent, the correct course of action was to declare bankruptcy long ago and forget about the phones. The fact that we're still trying to produce them (which I'm sure Justine would happily produce evidence of in court) is proof that we're trying with extremely limited capacity to un-fuck-over as many customers as we can.

Like many others, I have paid almost 3 years ago for an item that seems unlikely to materialize anytime soon. This is frustrating, to say the least. And yes, at times I feel cheated. Yet somehow I still believe in the honest intent at Sky's Edge to deliver on promises made. Call me foolish, naive, whatever...
That said, the lack of information on any progress (or lack thereof) leaves me wondering about the actual level of activities to produce RUSPs. This silence is adding to the frustration. It would be immensely helpful to see more frequent updates on if and when we could be expecting delivery. Or at least we could learn about the challenges at hand and how these are being tackled...
@everyone at Sky's Edge, what exactly keeps you from posting stuff on the blog, keeping us informed, and keeping our hope alive?

3 years later I still love the idea, and I still love Justine for attempting to bring it to market. That being said, I agree with @werwolf that I have my doubts when it comes to this project's progress. I would really, really appreciate a monthly update on the blog, even if it's just "sorry, we didn't do much this month but here's a picture of the PCBs"

I know there hasn't been an update on the "updates" page on the website in a while (

But I'm concerned and upset about "legal proceedings". Every time anyone emails us at
info@skysedge.com to ask for a refund, we process a refund. I know this has been a mess... I know. If I could push a button to undue this whole idea, I would do it. I've sunk so much of my life and time, time I could have spent with my husband, into this.

I think people have seriously misjudged the scope of the rusp project, which from the beginning was clear, a very ambitious hobby project handled solo, only gaining help after mechanical setbacks and life happening as it does, as orders continued to pile up. I continue to admire the dedication Justine had to start this project in the first place, and all of the skills needed, from programming to fabricating all the physical bits and bobs, to make the concept a reality especially during hard times, that's more than I could do. What I can do, is wait until the team catches up with the orders.
Seeing a "call for legal proceedings" against a hobbyist project like this with not even a bill of sale as evidence they made a purchase seems like trolling at the expense of others misfortune, as actual legal action would only further burden the progress of order fulfillment and negatively impact the rest of the customers.
